These Terms of Service ("Terms") govern your use of the VelosLuxe website (velosluxe.com) and all related services provided by VelosLuxe LLC ("VelosLuxe," "we," "us," or "our"). By accessing our website or using our services, including our SMS messaging program, you agree to be bound by these Terms.

1. Services

VelosLuxe provides AI-powered receptionist, appointment management, follow-up automation, and communication services for medical spa businesses. Our services include appointment scheduling, client communication via SMS and email, review management, and related marketing automation tools.

2. Eligibility and Age Restriction

You must be at least 18 years of age to use our services, including our SMS messaging program. By using our services, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms. If you are under 18, you may not use our website or services.

3. SMS Messaging Program

VelosLuxe operates an SMS (text messaging) program to communicate with clients who have provided explicit consent. By opting in to our SMS program, you agree to the following terms:

3.1 Description of SMS Program and Messaging Use Cases

VelosLuxe sends the following types of SMS messages to opted-in recipients:

Appointment confirmations: Confirming your scheduled medspa appointment date, time, and service details.
Appointment reminders: Reminding you of upcoming appointments to reduce no-shows.
Post-treatment follow-ups: Checking in on your treatment experience and providing aftercare instructions.
Review requests: Inviting you to share your experience after your visit.
Promotional offers: Special discounts, seasonal promotions, and loyalty rewards (marketing messages, only with explicit marketing consent).

3.2 Consent

SMS messages are only sent to individuals who have provided voluntary, explicit consent via our website booking form or in-person intake process. Consent to receive SMS messages is not required as a condition of purchasing any service or booking any appointment with VelosLuxe. Consent checkboxes are not pre-selected and are fully optional.

3.3 Message Frequency

Message frequency varies. Transactional messages (confirmations, reminders, follow-ups) are sent as relevant to your appointments. Marketing messages are sent no more than 4 times per month.

3.4 Message and Data Rates

Standard message and data rates may apply to all SMS messages sent and received, depending on your mobile carrier and wireless plan. VelosLuxe does not charge any fee for sending or receiving SMS messages, but your carrier may impose charges. Please check with your carrier for details about your plan.

3.5 How to Opt Out

You may opt out of VelosLuxe SMS messages at any time by using any of the following methods:

Text STOP: Reply STOP to any SMS message you receive from VelosLuxe. You will receive a one-time confirmation that you have been unsubscribed and will receive no further messages.

Email: Send an opt-out request to dallas@velosluxe.com with the subject line "SMS Opt-Out" and include the phone number you wish to unsubscribe.

Phone: Call us at (928) 582-1712 and request to be removed from SMS communications.

After opting out, you will no longer receive SMS messages from VelosLuxe unless you re-enroll by providing new consent.

3.6 Help and Support

3.7 Carrier Liability Disclaimer

Mobile carriers are not liable for delayed or undelivered messages. VelosLuxe, its affiliates, and any telecommunications providers involved in delivering SMS messages are not responsible for any delays, failures, or errors in the delivery of any SMS message, for any reason. Delivery of messages is subject to effective transmission by your mobile carrier and network conditions. Carriers, including but not limited to AT&T, T-Mobile, Verizon, and other carriers, bear no responsibility or liability for the SMS messaging program, including message content, frequency, or delivery outcomes. T-Mobile is not liable for delayed or undelivered messages.

3.8 Supported Carriers

Our SMS program is compatible with most major U.S. wireless carriers. Service availability may vary. If you change or deactivate your phone number, it is your responsibility to notify VelosLuxe so we can update our records.

4. Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you acknowledge that you have read and understand our Privacy Policy.

We do not sell, rent, or share your SMS opt-in consent data or phone number with third parties for marketing purposes. For full details on how we handle your data, please review our Privacy Policy.

5. Acceptable Use

You agree to use our website and services only for lawful purposes. You may not use our services to transmit any unlawful, harmful, threatening, abusive, or otherwise objectionable content. We reserve the right to terminate access to any user who violates these terms.

6. Intellectual Property

All content on velosluxe.com, including text, images, logos, design elements, and software, is the property of VelosLuxe LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

7. Disclaimer of Warranties

Our website and services are provided "as is" and "as available" without warranties of any kind, whether express or implied. VelosLuxe does not guarantee uninterrupted, secure, or error-free operation of the website or services, including SMS message delivery.

8. Limitation of Liability

To the maximum extent permitted by law, VelosLuxe LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website, services, or SMS program. Our total liability for any claim shall not exceed the amount you paid to VelosLuxe in the twelve (12) months preceding the event giving rise to the claim.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Maricopa County, Arizona.

10. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our services after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
